Windows Vista, can I get a refund?

It appears, disaster has already struck with some new Vista users, or should that be non-users?  Can they return it for a full refund?

In short, you're unlikely to get a refund unless the product is still unopened. The exact situation will vary from store to store and according to local consumer law.

I've only heard of one retailer, PCs for Everyone, who will take back opened copies of Vista.

The real issue here is, how do you know if it is going to run on your PC without crashing ten times every hour?

There are various software advisors which can be run, prior to purchasing, which will produce a report telling you which version is likely to work on your hardware - if any.  These advisors are not 100% reliable, however.

If you're unsure as to how to proceed, your best bet is to forget it for now. Otherwise, you may find that you have to shell out yet more cash on expensive hardware to get the OS working; you can be sure the big retailers will be more than happy to help you with that!

Even if you are one of the lucky ones and have Vista working acceptably, bare in mind that things are going to be slower than they were with Windows XP.  This is not something which is going to improve via software updates.  The only way to get the speed performance back will be to upgrade your hardware.
